Terms of Use

These Terms govern access to SeniorComps Inc's websites, hosted platform, data and related features (the Services). By using this site, you agree to these Terms. Do not access the Services if you do not agree. The dispute provisions below require individual arbitration, subject to their stated exceptions.

1. Your account and any company subscription

You must be at least 18 and authorized to use the Services. You accept these Terms personally. If you also accept for an organization, you represent that you are authorized to bind that organization; merely using a company email address does not establish that authority. A signed subscription agreement controls its commercial terms and any express conflicting provision. A user's acceptance does not amend the company's signed agreement or make that user personally responsible for the company's subscription fees.

Provide accurate registration information, keep it current, protect your credentials and notify info@seniorcomps.com promptly of suspected unauthorized access. Each account belongs to one named user; shared logins are prohibited. You are responsible for your activity and the access you authorize. Your company administrator may manage your account, content and permissions within the available company controls. Do not access another account or another company's information without permission.

2. License and permitted business use

While you have authorized access, we grant you a limited, nonexclusive, nontransferable right to use the Services for your or your organization's internal business purposes, within your plan, limits and permissions. External publication or redistribution of our nonpublic data requires our written permission or an express permission in your subscription. These restrictions do not transfer ownership of your own content to us or restrict your independent use of it.

SeniorComps and its licensors retain all rights in the platform, software, database compilations and content other than content you own. Access is a license, not a sale. Preserve ownership and source notices on permitted copies.

3. Use restrictions

Do not resell or sublicense access; redistribute our data as a dataset or data service; use it to build or enrich a competing database; or evade user, credit, export or security limits. Do not scrape, harvest or bulk extract data, use unauthorized automated queries, or reverse engineer the Services, except where law expressly permits. Automation through a feature or integration we expressly authorize is permitted within its stated limits.

Do not upload malware, disrupt the Services, impersonate others, infringe intellectual property or privacy rights, harass others, or use the Services unlawfully. Comply with applicable export controls and sanctions. You may not access the Services where prohibited by law. Do not upload resident or patient health information, Social Security numbers, or other sensitive personal information unrelated to the service.

4. Your content and sharing choices

Content remains owned by you or its existing owner. You represent that you have the rights and permissions needed for us to process it and for every sharing choice you make, including permissions for photographs, attachments and third-party information. Do not upload material subject to confidentiality or provider restrictions inconsistent with those choices. Use reasonable care to submit accurate information and promptly correct known material errors.

We may process your private content to operate, secure and support the Services, follow authorized instructions, and comply with law. Service providers may process it for those purposes under confidentiality obligations. Private content is available only through applicable account permissions, authorized sharing, necessary service administration and lawful disclosures.

For content you deliberately submit for sharing beyond your company group, you grant SeniorComps and its permitted distributors a perpetual, irrevocable, worldwide, royalty-free, nonexclusive and sublicensable license to retain, reproduce, validate, correct, combine, adapt, display, distribute and license that content in SeniorComps data products. This license survives account closure, subject to applicable privacy law. It excludes private content and information not designated for that sharing. Previously distributed copies and independently sourced information may remain available after a submission is removed. Only share content you are authorized to share.

5. Confidentiality and privacy

Protect nonpublic SeniorComps data and other confidential information you receive through authorized access. Use it only as permitted and do not disclose it outside authorized recipients. We will protect your private content and other nonpublic business information with reasonable care and limit its use and disclosure to providing the Services, your instructions and legal requirements. Authorized recipients must be subject to confidentiality obligations. Public, previously known, independently developed and lawfully received information is excluded. Required disclosures may be made with advance notice where lawful.

These confidentiality obligations continue for five years after access ends, and for trade secrets while protected by law. Our separately presented Privacy Policy explains personal-information practices; accepting it does not transfer ownership of your content, expand the shared-comp license or waive statutory privacy rights.

6. Availability and third parties

Maintenance, outages and events beyond reasonable control may affect access. Neither party is liable for delays beyond its reasonable control; payment and express refund obligations remain.

Public records, mapping, data feeds, integrations and optional AI features may depend on third parties and may change, contain errors or become unavailable. Additional third-party terms will be identified before you enable a feature requiring separate acceptance. A link is not an endorsement. Connecting an external account or enabling a feature may transmit the information needed to perform your request, as described in the Privacy Policy. Third-party limitations do not excuse our own express confidentiality obligations.

7. Data accuracy and warranties

Independently verify data, assumptions and outputs before relying on them. Comps, estimates, analyses and AI-generated outputs may be incomplete, stale or wrong and are informational tools, not appraisals or legal, tax, accounting, financial, investment, medical or other professional advice. Neither a comp review nor a credit award guarantees accuracy, completeness, suitability or an investment outcome.

EXCEPT FOR EXPRESS COMMITMENTS IN THESE TERMS OR YOUR SIGNED AGREEMENT, THE SERVICES AND DATA ARE PROVIDED AS IS AND AS AVAILABLE. TO THE EXTENT LAWFUL, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. We do not warrant error-free or uninterrupted operation, the accuracy of third-party or member content, or compatibility with every external system. Nothing limits rights that applicable law does not allow to be limited.

8. Suspension and termination

We may suspend access reasonably necessary to address a material security threat, unlawful conduct, unauthorized disclosure, or a material violation of these Terms. We will give notice and an opportunity to resolve the issue where reasonably practicable. We may terminate for a material breach not cured within 30 days after emailed notice, or immediately for an incurable breach. We may end free access on reasonable notice, or immediately for a material threat or misuse.

You may close your account, but doing so does not cancel a company subscription or eliminate payment commitments. Export content you own while your access remains available; we do not promise access after termination.

On request, we will return or delete private confidential content, subject to applicable rights of your organization, legal retention and protected routine backups. Personal-information requests follow the Privacy Policy. Shared-comp licenses survive as stated above. Ownership, accrued payment obligations, confidentiality, restrictions on retained content, indemnity, liability limits and dispute provisions survive to the extent needed to give them effect.

9. Responsibility for third-party claims

You will defend SeniorComps against third-party claims caused by content you lacked authority to submit or share, your infringement of others' rights, or your unlawful use of the Services, and pay final damages and approved settlements. This does not cover claims caused by SeniorComps' own breach or misconduct. We will promptly notify you, permit you to control the defense with competent counsel, and reasonably cooperate at your expense. Delayed notice reduces your obligations only to the extent it materially prejudices the defense. You may not settle a claim by imposing an admission, nonmonetary obligation or unreleased liability on us without our written consent.

10. Liability limits

TO THE EXTENT LAWFUL, NEITHER PARTY IS LIABLE UNDER THESE TERMS FOR CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUES. Each party's aggregate liability relating to these Terms or the Services is limited to the fees paid or payable for the affected subscription in the 6 months before the first event giving rise to liability. The limit is not multiplied by users or claims. Third-party indemnity awards and defense costs are direct damages within that cap. For claims governed by a signed subscription agreement, its liability limits control; these Terms do not provide an additional liability allowance or permit duplicate recovery.

These limits do not apply to payment or express refund obligations, your unauthorized use or disclosure of our data or intellectual property, fraud, willful misconduct, gross negligence, or liability that cannot lawfully be limited.

11. Disputes and governing law

Florida law governs, excluding its conflict-of-law rules. Except where a signed agreement controls, disputes arising from these Terms or your use of the Services will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator in Miami-Dade County, Florida. The Federal Arbitration Act governs this arbitration provision. Judgment on an award may be entered in a court with jurisdiction. Either party may seek temporary court relief to protect intellectual property or confidential information without waiving arbitration.

TO THE EXTENT LAWFUL, YOU AND SENIORCOMPS WAIVE JURY TRIAL AND CLASS OR REPRESENTATIVE PROCEEDINGS; DISPUTES MUST BE RESOLVED INDIVIDUALLY. Applicable statutory limitation periods apply. For proceedings permitted in court, the parties consent to the state and federal courts serving Miami-Dade County, Florida, except where mandatory law requires otherwise. This section survives termination.

12. Changes and other terms

Material changes to these Terms apply prospectively to existing members only after advance notice and renewed acceptance, except where law requires otherwise. New members accept the version presented at signup. Posting alone cannot amend a signed agreement, authorize charges, expand rights in previously private content or change an accrued dispute.

Neither party may use the other's name or logo for publicity without permission. Accounts and licenses require consent to transfer. We may assign with a business transfer if the successor assumes our obligations. Nonenforcement is not waiver; invalid provisions do not affect the remainder.

Contact info@seniorcomps.com for notices, questions, privacy requests or copyright complaints. Identify the account or content and issue; copyright notices must include legally required information. We may remove infringing content and terminate repeat infringers. We send legal notices to your registered email, unless your signed agreement specifies otherwise.

Privacy Policy

This Policy explains how we collect, use and disclose personal information through our websites, platform, support and business communications. Acceptance acknowledges these practices; it does not waive privacy rights or transfer ownership of your content.

1. Information we collect

Account and business information. We collect information supplied by you, your company administrator or someone acting for your organization, such as your name, work email, phone number, company, role, login details, account preferences and subscription or billing information.

Content and communications. We process property and comp records, photographs, notes, deals, uploaded files, support requests and other information you submit. Content can contain business contact details or other personal information. Submit only information you have authority to provide and do not include resident or patient health information or unrelated sensitive personal information.

Usage and device information. We collect information needed to operate and protect the Services, such as IP address, browser and device characteristics, login and activity records, pages or features used, searches, exports, transactions, technical errors and timestamps. Cookies and similar technologies support sessions, preferences, security and usage measurement.

Information from other sources. We may receive relevant information from your organization, other members, public property records, licensed data suppliers, connected services you enable and payment providers. These sources may supply business contact information, property data and payment or transaction status. Information is not automatically nonpersonal merely because it concerns a business or appears in a comp.

2. How we use information

We use information to create and administer accounts; authenticate users and enforce permissions; deliver subscriptions, searches, analyses, exports and sharing; process billing; review comps and credits; respond to support requests; diagnose problems and improve the Services; detect misuse and protect security; meet legal obligations; and establish, exercise or defend legal claims.

We send account, billing, security and service communications and may send information about SeniorComps products or updates. You can unsubscribe from marketing emails; necessary service messages continue while relevant. We do not provide account contact details or private company content to unrelated third parties for their own marketing without permission. Licensing deliberately shared comp data, as explained below, is separate from providing account contact lists for marketing.

3. Private content and shared comps

SeniorComps personnel and service providers may access private information as needed to operate, secure or support the Services, carry out instructions or comply with law. Company administrators may manage accounts and content within their permissions.

If you deliberately submit a comp for sharing with the broader membership, we may review, combine, correct, publish and license that comp through SeniorComps products, including to paying members and permitted distributors. Shared content may include the property information, financial metrics, photographs and authorized business contact information you include. Do not include private personal information in a shared submission. The sharing license is described in the Terms of Use or your organization's agreement; this Policy does not expand it.

Removing a submission or closing an account may not remove previously distributed copies or information obtained independently from another lawful source. We address personal-information requests as required by law. We do not claim ownership of all information you provide simply because it passes through our Services.

4. Recipients and connected services

Service providers. We disclose information to providers that help with hosting, authentication, communications, billing, analytics, security and support, limited to the purposes for which they assist us and subject to appropriate confidentiality and data-use restrictions.

Your organization and selected recipients. Information may be available to administrators, authorized colleagues and company groups according to the relevant permissions and sharing choices. Ask your administrator about your organization's access and retention practices. Members and permitted distributors may receive deliberately shared comp content as described above.

Connected and optional features. If you connect an external service or request a feature that uses a third-party provider, information needed for that function may be transmitted to that provider. This can include prompts, relevant records or attachments for an AI-assisted feature when offered and enabled. Such processing does not authorize general redistribution of private content. We do not authorize use of private content to train general-purpose AI models without separate permission. Independently operated services you choose to connect may have their own privacy practices; review them before connecting.

Legal and business events. We may disclose information where reasonably necessary to comply with law or lawful process, protect rights or safety, investigate fraud or misuse, or complete a merger, financing or business transfer, subject to appropriate protections. A successor must respect applicable obligations; a business transfer does not itself authorize broader uses of private content.

We may use and disclose aggregated or deidentified information for analysis and service improvement where individuals cannot reasonably be identified. We will maintain it in that form and will not attempt to reidentify it except as permitted by law.

5. Cookies and choices

We use cookies or similar technologies for essential functions and may use them to understand website and feature usage. You can manage cookies through your browser and any choices we make available on the site; blocking essential cookies may prevent login or other functions. Where consent is required for nonessential technologies, we seek it before using them. A general acceptance of this Policy is not a substitute for that consent.

Unsubscribe from marketing using the link in our emails or contact info@seniorcomps.com. Disconnect integrations through available settings or request assistance. We honor legally required opt-out preference signals, including Global Privacy Control where applicable. Browser Do Not Track signals do not have a uniform standard; this does not limit any required response to recognized privacy signals.

6. Retention and security

We retain personal information for as long as reasonably needed for the purposes described here, considering the account relationship, the nature of the information, legal and accounting obligations, security needs and dispute resolution. Different records may have different retention periods. Routine backups may retain information until overwritten under applicable retention practices and remain protected. Deliberately shared comps may be retained under their continuing license, subject to applicable privacy law; private content is not converted into shared content on account closure.

We use reasonable administrative, technical and physical safeguards appropriate to the information and risks. No system is completely secure. Protect your credentials and report suspected unauthorized access promptly. We will provide legally required notices of a personal-information breach. This Policy does not promise a particular security certification or absolute protection.

7. Requests and privacy rights

You can review or update information through available account settings or by emailing info@seniorcomps.com. Depending on your location, the applicable law and its coverage of SeniorComps, you may have rights to access or obtain a copy of personal information, correct it, request deletion, restrict certain uses or disclosures, and opt out of covered sales, sharing, targeted advertising or certain profiling. Mention the right you want to exercise and your relationship to SeniorComps; do not email passwords or unnecessary sensitive documents.

We may need proportionate information to verify identity and authority, including for requests through an authorized agent. We respond within applicable legal deadlines and explain any permitted refusal. Where an appeal right applies, email us with Privacy Appeal in the subject line. We do not unlawfully discriminate against someone for exercising privacy rights. When information is controlled by your organization, we may refer your request to it or assist it in responding. Requests may be limited by others' rights, legal retention and applicable exceptions.

California residents may also ask about disclosures of personal information for third parties' direct marketing under California Civil Code section 1798.83, where applicable. Contact us at the email below.

8. Location and children

SeniorComps is based in the United States. Information may be processed in the United States and other countries where our service providers operate; their laws may differ from those where you live. We use safeguards required by applicable law for covered international transfers. Accepting this Policy does not waive mandatory protections.

The Services are intended for adult business users and are not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided such information, contact us so we can investigate and take appropriate action.

9. Updates and contact

We will post updated versions with their revision date and give notice of material changes by email or in the Services. Where needed, we will seek renewed acceptance or separate consent before applying a change. Posting a revised policy alone does not authorize materially broader use of previously collected information, expand rights in private content or override a signed agreement. New members receive the version presented when they join.
